1. Acceptance of Terms 

All resource material is copyrighted and cannot be replicated in any way, including but not limited to taking screen shots, copying, printing, or sharing. By purchasing, accessing, registering for, or using this service, including any computerized adaptive testing (CAT) exam, assessment exam, readiness exam, question bank, rationales, scoring reports, analytics, study tools, written materials, video content, or related services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the service.

2. Educational Purpose Only

This service is provided solely for educational, informational, and exam-preparation purposes. It is intended to simulate certain testing features and provide users with practice opportunities related to NCLEX-style testing. It is not the NCLEX examination and is not affiliated with, endorsed by, or sponsored by the National Council of State Boards of Nursing (NCSBN), Pearson VUE, or any board of nursing.

3. No Guarantee of Passing the NCLEX

Use of this service does not guarantee that you will pass the NCLEX or any other licensing or certification examination. Any score, readiness level, probability estimate, performance band, adaptive result, or feedback generated by this service is only an estimate based on our proprietary methods and is not a promise, warranty, or assurance of future exam performance.

You acknowledge and agree that:

• performance on our CAT exam may not predict actual NCLEX performance;
• results may vary based on many factors outside our control;
• we do not guarantee licensure, certification, employment, academic progression, or examination success.

Any statement, advertisement, testimonial, or marketing content regarding user outcomes is illustrative only and does not create a guarantee or warranty.

4. User Eligibility and Account Responsibility

You are responsible for ensuring that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

You may not:

• share your account with another person;
• allow another person to take an exam using your account;
• use another user’s account;
• misrepresent your identity;
• attempt to circumvent access controls, usage limits, or security features.
• Attempt to take screenshots, copy materials, share accounts.

We reserve the right to suspend or terminate accounts or take further action if use is suspected of misuse, fraud, unauthorized access, or violation of these Terms.

5. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the service for your personal, individual, non-commercial educational use only.

No ownership rights are transferred to you. All rights not expressly granted are reserved by us.

6. Intellectual Property

All content included in or made available through the service is owned by or licensed to us and is protected by copyright, trademark, trade secret, and other intellectual property laws. This includes, but is not limited to:

• exam questions;
• item stems;
• answer choices;
• rationales;
• test-taking strategies;
• scoring methods;
• test blueprints;
• exam structure;
• CAT algorithms;
• reports;
• graphics;
• branding;
• videos;
• PDFs;
• study guides;
• website content;
• software code.

Our test items, adaptive exam methods, and related materials are proprietary and confidential.

7. Strict Prohibition on Copying, Screenshots, Recording, and Distribution

To protect the integrity and security of our proprietary materials, you may not, and may not permit any other person to:

• copy, reproduce, distribute, publish, transmit, display, sell, license, or exploit any exam content;
• screenshot, screen-record, photograph, videotape, scan, download, print, capture, save, or otherwise preserve any test question, answer option, rationale, report, or other content;
• copy and paste any test content into another document, device, website, application, chatbot, AI tool, tutoring platform, or storage system;
• share or post any content on social media, websites, forums, group chats, cloud drives, or file-sharing services;
• memorize and reconstruct questions for sharing, resale, or distribution;
• create derivative works based on our content;
• scrape, mine, extract, harvest, or systematically collect data or content from the service;
• use bots, scripts, browser extensions, plugins, or automated tools to access, capture, or reproduce content;
• reverse engineer, decompile, disassemble, or attempt to discover the underlying structure, item bank, scoring logic, or adaptive algorithm.

Any unauthorized use, copying, or distribution of our content is a material violation of these Terms and may result in immediate termination of access, cancellation without refund, legal action, injunctive relief, and pursuit of damages and attorney’s fees where permitted by law.

8. Test Security and Monitoring

We reserve the right to use technical, contractual, and administrative measures to protect the integrity of our exams and materials. We may monitor usage patterns, IP addresses, device activity, access logs, timing patterns, and other indicators of misuse, unauthorized sharing, harvesting, or security violations.

If we believe that content theft, account sharing, item exposure, or other misconduct has occurred, we may:

• suspend or terminate your access immediately;
• invalidate exam results;
• refuse future access or purchases;
• investigate suspected misconduct;
• cooperate with legal counsel or law enforcement where appropriate.

9. User Conduct

You agree to use the service lawfully and ethically. You may not use the service in any way that:

• violates any law or regulation;
• infringes intellectual property or privacy rights;
• compromises test integrity;
• interferes with the service or its security;
• harms our business, brand, users, or content.

10. Fees, Payments, and Refunds

All fees are due as stated at the time of purchase. By purchasing the service, you agree to pay all applicable charges.

Unless otherwise stated in writing, fees are non-refundable once access has been granted or the exam has been started, accessed, viewed, or used in any way. We reserve the right to deny refund requests where account misuse, content capture, sharing, or other violations are suspected.

11. Access Period and Availability

Access to the service is granted only for the time period stated at purchase. We may modify, update, restrict, or discontinue any part of the service at any time, with or without notice. We do not guarantee uninterrupted availability, error-free operation, or compatibility with all devices or browsers. 

12. Scores, Reports, and Analytics

Any score report, readiness category, recommendation, analytics dashboard, or performance summary is provided for educational use only. These outputs are estimates generated from our own content and methods and should not be interpreted as official licensure decisions, educational placement decisions, or guarantees of future performance.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the service is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or results.

We do not warrant that:

• the service will meet your expectations;
• the service will be uninterrupted or error-free;
• defects will be corrected;
• the service will predict NCLEX outcomes;
• the service will lead to passing any exam.

14. Limitation of Liability

To the fullest extent permitted by law, NurseForwardTM and its owners, officers, employees, contractors, affiliates, licensors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, educational opportunity, employment opportunity, or licensure opportunity arising out of or related to your use of or inability to use the service.

Our total liability for any claim arising out of or related to the service shall not exceed the amount you paid for the specific service giving rise to the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless NurseForwardTM and its owners, officers, employees, contractors, affiliates, licensors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorney’s fees, arising out of or related to:

• your use or misuse of the service;
• your violation of these Terms;
• your infringement or misappropriation of our intellectual property or other rights;
• your violation of any law or rights of a third party.

16. Termination

We may suspend, restrict, or terminate your access at any time, with or without notice, if we believe you have violated these Terms or threatened the integrity, security, or intellectual property of the service.

Upon termination, your right to use the service ends immediately. The sections relating to intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, and all provisions that by their nature should survive shall survive termination.

17. Privacy

Your use of the service is also subject to our Privacy Policy, if applicable. By using the service, you consent to the collection and use of information as described in that policy.

18. Modifications to Terms

We may revise these Terms at any time by posting an updated version. Your continued use of the service after updated Terms are posted constitutes your acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of laws principles.

20. Dispute Resolution

Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction and venue of those courts, unless applicable law requires otherwise.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms constitute the entire agreement between you and NurseForwardTM regarding the service and supersede all prior or contemporaneous communications, understandings, and agreements relating to the subject matter.
